Welcome to ucm.jobs!
Please read the following terms of use, which apply to all users of the ucm.jobs app (hereinafter referred to as “app”). By using this app, you agree to be bound by these terms of use. The owner of the app reserves the right to change, delete or add to the information in this app at any time without prior notice.
§ Scope of validity
The following terms and conditions apply to the use of the application ucm.jobs (hereinafter also referred to as “app”), which is provided by uCastMe GmbH, represented by its managing director (hereinafter referred to as “we” or “UCM”), for you as a user of this app. In order to use the app, it is important that you as a user accept the following terms and conditions.
By using the app, you agree to the terms of use of our app. By agreeing, you guarantee us that you will not create any posts that violate the terms of use.

§ Availability of the app
The app has a basic availability of 24 hours a day. However, there may be interruptions in availability due to maintenance required for the app/system. Interruptions in availability may occur due to force majeure or other causes beyond UCM’s control.
UCM points out,
- that it is technically impossible to provide the app free of errors of any kind and that UCM therefore accepts no responsibility for this,
- that errors can lead to the temporary deactivation of the app,
- that the availability of this App is dependent on conditions and performance outside UCM’s control, such as transmission capacity and telephone/internet connections between the individual parties. We are not responsible for any disruptions falling into this area.
§ Discussion forums
To the extent that we offer discussion forums on the app on a temporary or permanent basis, you as a participant in the discussion forums are expected to observe the usual rules of communication such as mutual respect. Visitors must not distribute or post any offensive, possibly derogatory, foul, indecent, defamatory or obscene material or material that infringes the intellectual property rights of third parties.
§ Electronic communication
When you use the UCM app or send emails, text messages, WhatsApp messages or other communications to us from your computer or mobile device, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, including via email, text messages, WhatsApp messages, or by posting electronic messages or other communications on our app. For contractual purposes, you agree to receive electronic communications from us and that all consents, notices, disclosures and other communications that we provide to you electronically do not need to be in writing unless mandatory legal requirements require a different form of communication.
§ Copyright and database rights
All content included in or provided through any UCM service, such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations, is the property of UCM or third parties supplying content or making it available in the app and is protected by German copyright and database right laws.
The entire stock of Content included in the App by UCM or provided by us is also the exclusive property of UCM and is protected by German copyright and database right laws.
You may not systematically extract and/or re-use any part of a UCM service without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) any substantial parts of any UCM Service for re-use without UCM’s express written consent. You also may not create and/or publish your own database that includes substantial portions of any UCM Service without UCM’s express written consent.
§ Registration, Profile
After successful registration and activation of your profile, we reserve the right to conduct a telephone interview with you in order to be able to display suitable offers for employment from companies (hereinafter “job offers”) in the app.
The job offers initially represent non-binding information and applying for such a job offer does not necessarily result in a successful job.
You can only apply for a job offer as soon as you have filled in all the relevant information in your profile and uploaded your matriculation and work visa (if applicable) and these have been verified by us.
The UCM app will show you the jobs that match the information in your profile (e.g. preferred cities, language skills, preferred job types, etc.). You can change and/or adapt these settings in your profile at any time. You can apply for a job offer by clicking on the “Apply” button in the view of the respective job offer.
Subsequently, the client and/or the project manager has the possibility to accept you for the job and to send you an assignment. The next step is to confirm the job in your profile. If you do not confirm the assignment at least 24 hours before the job starts, we reserve the right to withdraw your application and the assignment. This ends the process at this point and an employment contract is not concluded. (You are not obliged to perform any work, but you will also not receive any payment).
However, if the confirmation is successful, you have sent us a binding offer to which you are bound. With this confirmation, you will automatically receive an employment contract signed by UCM, which you can download from your profile at any time. You sign this and send it back to us by post; after our acceptance, the contract is concluded.
You will start working for the company in question on the agreed date. You will receive this information through a briefing, which we will make available to you in your profile and which you must confirm before starting the job.

§ Responsibility of the user, exemption from UCM
In order to prevent and/or mitigate damage, you are primarily responsible for preventing avoidable damage to yourself and third parties with the help of the control options that we provide for the administration of your profile.
In all disputes between you and third parties in connection with the user content provided by you, you are solely responsible for the legality of the content used by you. Should third parties assert such claims against UCM, you will indemnify UCM against any resulting claims by third parties. This does not apply if you are not responsible for the infringement.
In the event of a claim by a third party, you are obliged to provide UCM immediately, truthfully and completely with all information that could be necessary for the examination of the claims and a defence. You will bear all reasonable costs incurred by UCM due to an infringement of third party rights, including the reasonable costs incurred for the legal defence.
§ Data protection
The collection, processing and storage of personal data by UCM is carried out exclusively in accordance in accordance with the requirements of German data protection law and the European General Data Protection Regulation. For further information regarding your consent and other information on data collection, processing and use, please refer to the data protection declaration, which can be accessed at any time on the UCM website.
§ Claims from intellectual property rights
UCM respects the intellectual property rights of others. If you believe that your intellectual property rights have been used in a way that gives rise to a concern of infringement, please follow our procedure for notifying UCM of infringement.
§ Liability
We will always endeavour to ensure that UCM’s services are available without interruption and that transmissions are error-free. However, due to the nature of the Internet, this cannot be guaranteed. Your access to UCM’s services may also occasionally be interrupted or restricted to allow for repairs, maintenance, updates or the introduction of new facilities. We will attempt to limit the frequency and duration of any such temporary interruptions or limitations.
UCM shall be liable without limitation insofar as the cause of the damage is based on an intentional or grossly negligent breach of duty by UCM or a legal representative or vicarious agent of UCM.
Furthermore, UCM is liable for the slightly negligent breach of essential obligations. Essential obligations are obligations whose breach endangers the achievement of the purpose of the contract or whose fulfilment makes the proper execution of the contract possible in the first place and on whose compliance you regularly rely. In this case, however, UCM is only liable for the foreseeable, contract-typical damage. UCM is not liable for the slightly negligent breach of obligations other than those mentioned in the above sentences.
The above limitations of liability do not apply in the event of injury to life, limb or health, for a defect after a guarantee has been given for the quality of the product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
Insofar as UCM’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
§ Other
These GTC and the contract of use regulated therein are subject to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
